All of the following terms and conditions must be
adhered to and are legally binding immediately upon agreement and
when the host is accepted into the Wahoo Computers affiliate program.
The company (Wahoo Computers) reserves the right to terminate any
agreement at our discretion. Please read over these rules carefully.
It is recommended that you print this page out for quick reference.
DO NOT SPAM IN ANY WAY. We detect and discard all clicks from e-mail,
newsgroups, chat rooms ICQ and all other methods than a web page.
Spamming by any of these methods is pointless, the clicks will be
discarded, and your account will be terminated.
*The company reserves the right to terminate any account of any
affiliate that is responsible for publicly posting any derogatory
and or slanderous statements about Wahoo Computers, other hosts,
advertisers, agents or employees of Wahoo Computers. We will defend
ourselves against any fraudulent, false, or slanderous statements
about our company.
*Affiliates that are caught cheating will have legal action brought
against them to compensate for any or all of the damages to our
company/program.
*Wahoo Computers will only be held liable to send payments to the
address that lists you in the domain name whois lookup database.
*You mayour banners in a new window, however, it must be
a FULL SIZED browser window...(example: _blank) eg NOT FRAMED.
*Only one account is allowed per company or organization. You may
use this account for as many domains and/or websites as you wish
as long as they are approved by Wahoo Computers first.
*Begging for clicks is not allowed. You may not ask visitors to
click Wahoo Computers banners in order to get information or access
to a certain website, etc...
*All clicks you send to us must come from a webpage. We do not
allow newsgroup postings with links to us. Nor do we allow email
links/ spamming or any other such practices that could reflect negatively
on our business. Failure to comply to this request will result in
the immediate cancellation of the account from which the clicks
were sent and also will result in the forfeiture of any funds owed
to that account. Clicks that come without a referring URL are not
counted.
*You must be the owner of any copyrighted content displayed on
your site. Also, you must be the holder of any trademarked terms
contained in your sites meta tags. Copy cat sites will not be allowed
or will be terminated. You must also be the owner of the site and
accounts are non transferable.
*No password protected sites will be allowed into the network unless
a functional username and password is provided free of charge to
Wahoo Computers. All webmasters that put our code on these types
of sites after approval will be terminated and loss of payment will
result.
*Wahoo Computers reserves the right to terminate your account for
60 days of inactivity. If after 30 days you do not receive a click
through (referral clicks DO NOT COUNT) we will then send you an
email telling you what the status is and give you additional days
to comply.
*Wahoo Computers takes no responsibility for technical problems
beyond our control, such as server downtime or network/Internet
trouble. If due to technical failure the banners cannot be shown
we reserve the right not to pay out during this time.
*All pages in your domain must be written in English.
*Wahoo Computers reserves the right to change the payout right
at anytime and will give up to 5 days notice. Payment Conditions:
Wahoo Computers has been designed to utilize the pay-per-sale advertising
model. Affiliates are paid only when a unique visitor on their website
clicks on the advertisers banners, visits their websites and purchases
a computer system. The amount paid per sales is currently at 2%
per unique customer purchase. Payment Period: Checks will be processed
and sent via traditional mail or Paypal within Thirty (30) business
days. Payment Schedule All Affiliates are paid no more than once
a month. If the money owed to the affiliate is less than the minimum
payment, the amount will be carried over to the next month's total
until it is reached.
*Wahoo Computers reserves the right to withhold payment to any
affiliate site that exhibits questionable click-through activity.

Banner Placement: Although displaying an advertiser's banner as
the sole banner on the upper third of each page is preferred and
has been proven to increase click-through rates, Hosts may decide
on the placement of banners within their site. However, the Wahoo
Computers banner may not be grouped together with more than three
full-sized banners on the same page.
The Wahoo Computers banner may not be placed on pages that contain
no content, or on websites/domains that have not been approved by
us. Affiliates may place the Wahoo Computers code on all appropriate
pages within an approved website/domain. Affiliates may not alter
the Wahoo Computers banner code except for placement purposes.
Affiliates may not put text under or above the banners that request
visitors to click on them. Hosts may use the following phrases word
by word by their banners: Please Visit Our Sponsor Please support
our sponsor Please support our advertisers If you would like to
request something else by your banner you can do so by contacting
us.
Everyone that signs up to host Wahoo Computers banners are pre-approved.
It is recommended that affiliates do not display the banners on
their websites until after you receive an email saying that you
have been approved. If an affiliate displays the banner before the
email is received, Wahoo Computers is not responsible for any amount
that the host has earned if denied and terminated due to not meeting
our requirements as laid out in these terms.

Hosts applying to join Wahoo Computers with the intent to generate
fraudulent click-throughs should be advised that the system will
detect and document all fraudulent activity. Fraud may result in
non-payment, removal from the network, and/or additional legal action.
Wahoo Computers reserves the right to require affiliates to provide
server log files upon request.
Autospawning of browsers, automatic redirecting of users, or any
other technique of generating "automated" click-throughs
is strictly prohibited. It is also prohibited to require users to
click on the advertiser's banner before entering any area of a website,
or to provide incentives of any kind to induce or require users
to click on advertiser's banners.
Affiliates may not use unsolicited e-mail or inappropriate newsgroup
postings to promote a website. Hosts may not encourage visitors
to click on the advertisers' banners in any way including email,
newsgroup postings, and/or chat sites.
Wahoo Computers reserves the right to deactivate an affiliate's
account at any time for activity or site content deemed inappropriate,
based on the sole discretion of Wahoo Computers. Any of the following
conditions may result in deactivation of a Host's account. Restrictions
include, but are not limited to: Sexual content (nudity, eroticism)
or foul language References to software piracy ('warez', 'cracking',
etc.) or any kind of hacking or phreaking Illegal mp3 sites Personal
or free webpages (Angelfire, Xoom, etc...)
*Wahoo Computers will constantly monitor all host sites for cooperation.
Any person, company, or affiliated group may have only one account.
However, each account may cover multiple websites/domains. All activity
for a given account will be consolidated into one report.
Wahoo Computers and the affiliates both reserve the right to cancel
accounts at any time. If the affiliates account is terminated, an
email will be sent to the affiliate.
Affiliates agree to indemnify and hold Wahoo Computers harmless
from and against any and all claims, demands, liabilities, expenses,
losses, damages or legal fees arising from any and all claims and
lawsuits for libel, slander, copyright, and trademark violation
as well as all other claims resulting from an affiliate's or advertiser's
web pages.
Wahoo Computers reserves the right to change the affiliate terms
and conditions at any time. Affiliates are responsible for complying
with any new rules posted here within 10 days of the date changes
are posted. Hosts should contact affiliates with
questions about the interpretation of any terms set forth in this
agreement. For special circumstances, modifications to these rules
may be made if approved via email. Location Of Case Of Dispute Affiliates
agree to settle any/all dispute(s) under this agreement via binding
arbitration in the United States of America.
ALL AFFILIATES MUST COMPLY COMPLETELY WITH ALL THE TERMS AND CONDITIONS
SET FORTH IN THIS AGREEMENT.
WAHOO COMPUTERS RESERVES THE RIGHT TO WITHHOLD PAYMENT FROM ANY
AFFILIATE THAT VIOLATES ANY OF THESE TERMS.
